<p>Tide Pods will be priced between regular Tide liquid and a more expensive variety known as Tide Total Care.  Executives at Procter are confident that the benefits offered by Tide Pods will outweigh reservations about cost.  Tide is the country’s best-selling detergent.</p>
<p>Sundar Raman, marketing director for North American fabric care at Procter in Cincinnati, said, “We want to shake this category up with innovation.  What you’re going to see from us is a little more risk-taking.” He added that the goal is to disrupt the routine habits of consumers who “automatically pick up the product they usually pick up” when shopping for laundry detergent.</p>
<p>The Tide Pods advertising campaign will appear in traditional, digital, mobile, and social media, as well as in stores.  Print ads will include QR, or quick response, codes that can be scanned to retrieve information about Tide Pods.  The campaign has a cheery, youthful attitude that is meant to emphasize the differences between Tide Pods and traditional detergents.</p>
<p>The commercials feature a remixed version of “Pop Goes the World,” a song by Men Without Hats originally released in 1987.  Attractive models are shown coming out of washers in fashionable outfits after joining the pod squad.  The colorful campaign will carry the theme “Pop in. Stand out,” playing upon multiple meanings of “pop,” as in making colors pop with brightness or popping a pod into a washer.</p>
<p>Tide Pods follows a trend that has been gaining traction in the marketing of household brands.  Procter, Clorox, Reckitt Benckiser, and Unilever have been attempting to continually deliver distinctive new products that pique the curiosity of high-technology savvy consumers.  Procter is the nation’s largest maker of packaged goods.</p>

<p>Kellogg’s chief executive, John A. Bryant, said in a conference call with analysts that Pringles is in 140 countries and offers “the potential for increased scale in Europe and a good entry point into snacking in Asia and Latin America.”  Internationally, the snack business is increasing in popularity and growing fast.</p>
<p>Kellogg decided to purchase the snack company after an earlier agreement for Diamond Foods to buy the company fell apart.  Last spring, Pringles’ parent company, Procter &amp; Gamble agreed to sell the business to Diamond for $2.4 billion in stock.  Then, Diamond began facing criticism over questionable payouts to its walnut farmers and announced that it would have to restate two years’ worth of financial statements and it had put its chief executive on administrative leave.</p>
<p>Procter &amp; Gamble was forced to re-evaluate its plans and said it might have to consider alternatives for Pringles.  Mr. Bryant of Kellogg said in an interview that Kellogg was interested in Pringles last year, but it felt hard-pressed to compete with Diamond’s bid because of the lesser tax bill that would accompany the bid.  When Diamond’s offer collapsed, Kellogg and Procter &amp; Gamble came to an agreement within a matter of days.  Mr. Bryant said, “It’s an exciting asset and an iconic brand.  We moved very quickly.”</p>
<p>The deal adds a prominent brand to Kellogg’s existing lineup, helping the company increase its presence in the snack food industry.  Over the years, Kellogg has reduced its reliance on its mainstay cereal business, which includes Corn Flakes and Rice Krispies.  The company added Keebler in 2000, paying $4.5 billion for the company.  Kellogg’s current snack offerings include Keebler and Cheez-It.</p>
<p>Analysts with Stifel Nicolaus wrote in a research note, “The company already has a dominant position in the snacks category, including fruit snacks, granola bars, cookies, crackers, etc.  Pringles will simply add to this dominant market share position in these important growth categories.”  However, analysts at Jefferies &amp; Company were more skeptical, writing, “we find ourselves less than enthralled with the strategy behind purchasing a domestically tired brand that appears somewhat out of sync with the trends toward better-for-you snacking.”</p>

<p>Nestle&#8217;s sales growth of 7.5% in its continuing sales during the year was better than many analysts had expected.  Analysts had predicted growth of about 7%.  Overall sales fell to 83.6 billion francs ($91.11 billion) for 2011 from nearly 110 billion francs the previous year.  The decline was largely due to changes in currency rates and the impact of asset disposals.  The company expects organic sales growth in the next year to come in lower but still meet its target of 5%-6%.</p>
<p>Nestle’s full-year statement was accompanied with a warning that tough times lie ahead.  The company is grappling with volatile markets, rising commodity prices, and the strength of the Swiss franc.  The Swiss National Bank has intervened in the markets to try to stem the rise of the franc to protect many companies from significant losses.</p>
<p>Chief Executive Paul Bulcke said, “It was a challenging year, and we do not expect 2012 to be any easier.  We&#8217;re really living in a new reality.”  He referred to the world&#8217;s financial crises and political upheavals over the past year as &#8220;tectonic shifts&#8221; in which wealth was moving to developing nations and where governments were failing to solve big problems.  “That lowers consumer confidence,” he said.</p>
<p>Nestle revealed that it was continuing to grow in all world regions, with 5% growth in Europe and 6.4% growth in the Americas.  Sales increased 13.1% in Asia, Oceania, and Africa and some of the best growth appeared in India, Pakistan, North Africa, Central West Africa, and Egypt.</p>
<p>Nestle is the world&#8217;s biggest food and drinks maker, with the Nescafe, Perrier, Jenny Craig and Haagen Dazs brands under its control.  Nestle has 280,000 employees worldwide and factories or operations in almost every country in the world.  The company is a major buyer of food commodities such as wheat, sugar, milk, and coffee.</p>

				<content:encoded><![CDATA[<p>A Federal appeals court ruled on Tuesday that California’s voter-driven gay marriage ban was unconstitutional, in a contentious case which could lead to a significant Supreme Court case.</p>
<p>Those in favor of the ban have stated they would appeal the ruling. The Protect Marriage Collation, who sponsored the ban, said that the court’s decision wasn’t in-line with “every other federal appellate and Supreme Court decision.&#8221;</p>
<p>The 9th U.S. Circuit Court of Appeals ruled against the ban in a split decision, but did not specifically address whether or not marriage is a fundamental right that should be available to same-sex couples as well as heterosexuals. The two judges ruling in the majority opinion said that Proposition 8 did not further what was referred to as “responsible procreation,&#8221; which was a key argument forwarded by the ban’s supporters.</p>
<p>In 2008, California outlawed same-sex marriage with a voter-driven initiative which came to be known as Proposition 8. The conservative vote by the public was seen as a significant moment in what many refer to as the culture wars. Two gay couples responded to the ban by filing the legal challenge currently making its way through the federal courts.</p>
<p>A federal district judge in San Francisco stuck down the Prop 8 in 2010 and opponents immediately appealed the ruling to the 9th U.S. Circuit Court of Appeals. Both supporters and opponents of the legislation said they are ready to appeal the decision to the U.S. Supreme Court. A lawyer for the Protect Marriage Coalition said they have not decided whether or not they will ask a larger 9<sup>th</sup> Circuit panel to hear the case or whether they will appeal the matter directly to the U.S. Supreme Court.</p>
<p>The 9<sup>th</sup> Circuit Court of Appeals’ rules require that at least two weeks pass before a ruling takes effect. As a result, same sex marriages cannot immediately resume in California.</p>
